CONDITIONS OF USE

By using this site you signify your consent to the Term of Use. If you do not agree to these terms of use, please do not use this site.

These Terms of Use apply to the site on which it appears (the "Site"), which is owned and operated by YTV Canada, Inc. - a Corus Entertainment Company (referred to as "we," "us" or "our" herein) for your personal entertainment, information, education and communication. We welcome you to browse our Site, but want you to know that your access to, and use of, the Site is subject to the following terms and conditions ("Terms and Conditions") and all applicable laws. By accessing and browsing the Site, you accept, without limitation or qualification, the Terms and Conditions.

We will have the right at any time to modify or add to these Terms and Conditions, effective immediately upon posting of updated Terms and Conditions to this Site, with or without notice to you. If any such change is unacceptable to you, you may discontinue your use of the Site. You agree to periodically review the Terms and Conditions to be aware of such revisions. Your use of the Site may also be subject to additional rules or regulations we may have posted to this Site, including the Kid User Rules, as well as any additional or different terms or conditions imposed by third party content providers in connection with third party content, products or services accessible through the Site.

RESTRICTIONS ON USE OF MATERIALS

The Site contains material which is protected, nationally and internationally, by copyright and trademark laws. No material (including without limitation the text, images, audio and/or video) from http://www.ytv.com, http://www.ytv.ca, or any Web site owned, operated, licensed or controlled by us and/or by our affiliates and no software (including without limitation any images or files incorporated in or generated by the software or data accompanying such software) (individually and collectively the "Materials") may be copied, reproduced, republished, uploaded, downloaded, posted, transmitted, or distributed in any way or decompiled, reverse engineered or disassembled, except that you may download one copy of only such Material which is expressly so designated, and in such event, only on any single computer for your personal, non-commercial home use only, provided you keep intact any and all copyright and other proprietary notices. Modification of the Materials or use of the Materials for any other purpose is a violation of our and/or one or more third party's copyright, trademark and/or other proprietary rights. The use of any such Materials on any other Web site or networked computer environment is prohibited without our express written consent. If you download software from the Site, the software, including any files and/or images incorporated in or generated by the software, and data accompanying the software (collectively, the "Software") are licensed to you by us. We do not transfer title to the Software to you. You own the medium on which the Software is recorded, but we retain full and complete title to the Software, and all intellectual property rights therein. You may not re-sell, decompile, reverse engineer, disassemble or otherwise reduce the Software to a human-perceivable form. SUBMISSIONS

We are pleased to hear from our loyal fans and welcome your comments regarding our products, including our on-line services. Our long-standing company policy, however does not allow us to accept or consider unsolicited creative ideas, suggestions or materials. We hope you will understand that it is the intent of this policy to avoid the possibility of future misunderstandings when projects developed by our professional staff might seem to others to be similar to their own creative work. Accordingly, we ask that you do not send us and we will not accept, consider or review any original creative materials such as songs, stories or character ideas, screenplays, or original artwork. While we do value your feedback on our services and products, we request that you be specific in your comments on those services and products, and not submit any creative ideas, suggestions or materials.

If, despite our request that you not send us any creative materials, you send us creative suggestions, ideas, notes, drawings, songs, concepts or other information or if you transmit to the Site by electronic mail or otherwise, communications including any data, questions, comments, suggestions, or the like (collectively, the "Information"), then by such action you have waived any and all proprietary rights which you may have in such materials. None of the Information shall be subject to any obligation of confidentiality on our part and we shall not be liable for any use or disclosure of any Information. Without limitation of the foregoing, we shall exclusively own all now known or hereafter existing rights to the Information of every kind and nature throughout the universe, shall be entitled to unrestricted use of the Information for any purpose whatsoever, commercial or otherwise, and we shall not owe any compensation to any third party.

MEMBERSHIP REGISTRATION

As part of the registration process, we collect some personal information. Information submitted is used in accordance with our Privacy Policy. Accounts for children 13 years of age and under are only enabled upon receipt of consent from the child's parent or legal guardian.

Each membership application is reviewed before it's enabled. If an account has an inappropriate username (e.g. one that contains the user's real name or bad words) or if you've provided false information, the account will be deleted.

THE GAMES

• You may not take advantage of a bug, exploit or game development oversight in design or programming in order to increase your level, experience points, creds or game status.
• You may not use a third-party software program in the game to gain an advantage in our games.
• You may not data mine or change the data that goes from us to you or you to us to gain advantage in our games. You may not alter the data between players to gain advantage in our games.
• You may not communicate about a bug, exploit or game oversight that can increase your level, experience, creds or game status on The Big Rip Forums or externally on third-party interactive forums. Bugs should be reported to us via our Contact Us pages.
• You may not trade or auction your in-game items, creds or accounts for real dollars in the real world OR for items in other third-party games.

You understand that if you break these rules that your account could be: flattened, suspended or banned from features in-game or on the site OR your account could be deleted outright without warning. We reserve the right to take the game down or change gameplay at any time without warning. We reserve the right to analyze the aggregate player and game data and provide aggregate data to third parties.

MESSAGE BOARDS

The Site may include message boards and chat rooms that allow feedback to us and real-time interaction between users. We do not control the messages, information or files delivered to Message Boards, unless otherwise noted therein. Use of Message Boards is entirely at your own risk. However, we reserve the right at all times to disclose any information arising out of or relating to transmissions through Message Boards including without limitation as necessary to satisfy any law, regulation or governmental request, and further reserve the right to edit, refuse to post or to remove any information or materials, in whole or in part, that in our sole discretion are objectionable or in violation of these Terms and Conditions. You should assume that Message Board communications are not confidential.

It is a condition of your use of the Message Boards and this Site that you do not:

• Restrict or inhibit any other user from using and enjoying the Message Boards;
• Post or transmit any unlawful, threatening, abusive, libelous, defamatory, obscene, vulgar, pornographic, profane or indecent information of any kind, including without limitation any transmission constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, provincial, national or foreign law;
• Post or transmit any information, software or other material which violates or infringes upon the rights of others, including material which is an invasion of privacy or publicity rights or which is protected by copyright, trademark or other proprietary right or derivative works with respect thereto, without first obtaining permission from the owner or right holder;
• Post or transmit any information, software or other material which contains a virus or other harmful component; Post, or transmit or in any way exploit any information, software or other material for commercial purposes or which contains advertising, promotion or marketing;

• Share or transfer password or other access information with any other party, temporarily or permanently.

If you submit content to us on this Site, you hereby grant to us a limited, non-exclusive, sub-licensable, worldwide, fully-paid, royalty free license to use, modify, publicly perform, publicly display, reproduce, and distribute the content you submit. This license includes the right to host, index, cache, distribute, and tag such content, as well as the right to sublicense the content to third parties, including other users, for use on other platforms, such as for use on mobile phones, in video or music software computer programs. You represent and warrant that you own any such content you submit, display, publish or post on the Site, and otherwise have the right to grant the license set forth herein. We assume no liability for any information removed from this Site, and reserves the right to permanently restrict access to the Site or your account.

JURISDICTIONAL ISSUES

Unless otherwise specified, the materials in the Site are presented solely for the promotion of programs, films and other products available in Canada, its provinces, territories, possessions and protectorates. We control and operate this Site from our offices within the Province of Ontario, Canada. We make no representation that materials in the Site are appropriate or available for use in other locations. Those who choose to access this Site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. Software from this Site is further subject to Canadian export controls.

TERMINATION

This agreement is effective until terminated by either party. You may terminate this agreement at any time by destroying all materials obtained from any and all of our sites and all related documentation and all copies and installations thereof, whether made under the terms of this agreement or otherwise. This agreement will terminate immediately without notice from us if, in our sole discretion, you fail to comply with any term or provision of this agreement. Upon termination, you must destroy all materials obtained from this Site and any and all of our other sites and all copies thereof, whether made under the terms of this agreement or otherwise.

DISCLAIMER

Your use and browsing of the Site is at your risk. If you are dissatisfied with any of the Materials contained in the Site, or with any of these Terms and Conditions, your sole and exclusive remedy is to discontinue accessing and using the Site. We do not warrant that the functions contained in the materials will be uninterrupted or error-free, and/or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the materials in this Site in terms of their correctness, accuracy, reliability, or otherwise. MISCELLANEOUS

This agreement shall be governed by and construed in accordance with the laws of the Province of Ontario, without giving effect to any principles of conflicts of law. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the subject matter herein and shall not be modified except in writing, signed by both parties.

We shall have the right at any time to (a) change these Terms and Conditions, or (b) change the Site, including eliminating or discontinuing any content or feature of the Site, restricting the hours of availability, or limiting the amount of use permitted. Such changes, modifications, additions, or deletions shall be effective immediately upon implementation. We may or may not provide notice, in such form that we determine appropriate, including, but not limited to, posting a notice on the Site, or sending a notice by electronic or conventional mail. Your use of the Site after any changes shall be deemed to constitute your acceptance of such changes, modifications, additions, or deletions.

Our failure to comply with the Terms and Conditions because of an act of God, war, fire, riot, terrorism, earthquake, actions of federal, state or local governmental authorities or for any other reason beyond our reasonable control, shall not be deemed a breach of these Terms and Conditions.

If we fails to act with respect to your breach or anyone else's breach on any occasion, we shall not be deemed to be waiving our right to act with respect to future or similar breaches.

If any provision of these terms of use shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these terms of use and shall not affect the validity and enforceability of any remaining provisions.

The headings in these Terms and Conditions are for your convenience and reference. These headings do not limit or affect these Terms and Conditions.

These Terms, together with those items made a part of these terms by reference, make up the entire agreement between us relating to the Site, and replaces any prior understandings or agreements (whether oral or written) regarding the Site. If a court finds any of these terms to be unenforceable or invalid, that term will be enforced to the fullest extent permitted by applicable law and the other terms will remain valid and enforceable. The Site and any promotions contained thereon is void where prohibited. IF YOU DO NOT AGREE TO THE FOREGOING TERMS AND CONDITIONS OR ARE NOT AUTHORIZED TO ENTER INTO THESE TERMS AND CONDITIONS, PLEASE EXIT THE SITE.

These Terms and Conditions constitute a the entire agreement between us, and are a binding agreement between us that is accepted by you upon your use of the Site.
